⚠️ ECU Brick Risk & Customer Responsibility
In Plain Words — Read This Before Any Tuning Work
Flashing, remapping or modifying an ECU ALWAYS carries an inherent risk of permanent damage ("bricking"). No tuning provider anywhere can eliminate this risk — not us, not anyone. A power drop during flashing, an unstable OBD/bench connection, a faulty or cloned interface, corrupted memory cells, hidden previous modifications, or an unexpected ECU lock can render an ECU unusable. By using DaVinci Deluxe, DaVinci Deluxe · Cloud Edition, Cloud Tuning or any file or software we provide, you accept that every flash is performed entirely at YOUR OWN RISK and under YOUR OWN RESPONSIBILITY.
1. Every Job Is Performed Under the Customer's Sole Responsibility
All files, software and services are provided strictly "AS IS", without warranty of any kind. You — the customer — are the person physically writing data to the vehicle's ECU. You choose the vehicle, the hardware, the moment and the method. Accordingly, any damage to the ECU, the vehicle, or any connected component is your sole responsibility. We are never liable for consequential costs: towing, replacement ECUs, parts, labour, diagnostic time, vehicle downtime, or any indirect loss.
2. ALWAYS Make a Full Backup First
We advise it everywhere, and we repeat it here: before writing ANY modified file, read and safely store a complete backup of the ORIGINAL ECU content (full read where the ECU allows it). The original backup is your only guaranteed way back. If you flash without a verified backup, you accept the consequences alone. A failed flash with no backup is not a defect of our service — it is a risk you chose to take.
3. VIRGIN (Stock, Untouched) Files ONLY
Our software and our Cloud Tuning engine are engineered to work exclusively on VIRGIN files: original, stock ECU reads that have never been modified by any tuning tool — not by us, not by any other company or tuner. We do not accept or process files that were previously modified, and our systems actively detect and reject non-stock files.
If you deliberately bypass or deceive these checks — renaming files, patching bytes, hiding a previous modification, or submitting someone else's output as an "original" — any resulting malfunction or destroyed ECU is 100% your responsibility. Stacking modifications on top of an already-modified calibration can cause over-fuelling, overboost, immediate engine damage or a dead ECU. We warned you here, clearly and in advance.
4. Cloned / Counterfeit Flashing Hardware — NOT Recommended
We strongly advise against using pirated or cloned flashing devices — e.g. KESS clones, KTAG clones, MPPS clones, Galletto clones, "China clones" of any professional interface. Clone tools are notorious for: incomplete or corrupted writes, broken checksum handling, unstable voltage/communication, outdated protocol implementations, and permanently locking or destroying ECUs. Any damage caused in whole or in part by a cloned or counterfeit device is exclusively your responsibility. If you choose to use a clone, you do so entirely at your own risk. Use genuine, supported, professional equipment with a stable power supply.
5. Professional Use, Correct Procedure, Local Laws
Our products are intended for professional and competent users. It is your responsibility to: use a regulated power supply during flashing, never interrupt a write, verify hardware/software numbers match, test on the bench where appropriate, and comply with all laws applicable in your country (emissions-related modifications are for off-road / motorsport use only where street use is prohibited).
6. A Damaged ECU Is Not Grounds for a Refund
Because the risks above are inherent, disclosed and accepted in advance, a bricked or damaged ECU does not entitle you to a refund of software, licenses, credits, tokens or services (see our Refund Policy). What we DO offer: our free re-fix warranty on delivered files (press "Report a Problem" on the job) and honest support to get your vehicle back to stock with your original backup.
7. Acceptance
By purchasing, downloading, activating or using any DaVinci Deluxe product or service, you confirm you have read and accepted this ECU Brick Risk & Customer Responsibility statement, together with our Terms & Conditions and Refund Policy.
